Terms of Service

This English translation is provided for convenience. If there is any discrepancy between this translation and the Japanese original, the Japanese version shall prevail.

These Terms of Service (the "Terms") set out the conditions for using the iOS application "itsuka" (the "App") and its related website (together, the "Service"), provided by the itsuka team (the "Operator"). By using the Service, you (the "User") agree to these Terms.

Article 1 (Scope)

1. These Terms apply to all relationships between the Operator and the User concerning use of the Service.
2. By downloading or using the App, the User is deemed to have agreed to these Terms.

Article 2 (About the App)

1. The App is an application for recording, organizing and managing the User's wishes.
2. Data created in the App is stored only on the User's device. It is never transmitted to or stored on any server operated by the Operator.
3. Backing up data (export and import) is performed at the User's own initiative and responsibility. The Operator is not liable for loss of data caused by device failure, loss, replacement, deletion of the App, or similar events.

Article 3 (Requirements)

1. Using the App requires a device running a supported version of iOS, as stated on the App Store.
2. Any communication charges incurred in downloading or updating the App are borne by the User.

Article 4 (Paid Features)

1. The App offers "itsuka Plus", a one-time in-app purchase that unlocks additional features (the "Paid Service").
2. Purchases of the Paid Service are processed through the App Store payment system provided by Apple Inc. Payments and refunds are governed by Apple's terms and policies; the Operator cannot issue refunds directly.
3. Once purchased, the Paid Service remains available under the same Apple Account. After changing devices, it can be restored using the App Store's "Restore Purchases" feature.
4. The features unlocked by the Paid Service are determined by the Operator and may include features added in the future. Details are as displayed in the App and on its store page.

Article 5 (Intellectual Property)

All copyrights, trademarks and other intellectual property rights relating to the Service belong to the Operator or their rightful owners. The content of data the User creates within the App belongs to the User.

Article 6 (Prohibited Conduct)

In using the Service, the User must not:

• violate laws or public order and morals;
• reverse engineer, decompile, disassemble or otherwise analyze the App;
• interfere with the operation of the Service;
• infringe the rights or interests of the Operator or any third party; or
• engage in any other conduct the Operator reasonably deems inappropriate.

Article 7 (Disclaimer)

1. The Operator does not warrant that the Service is free of defects, whether factual or legal (including as to safety, reliability, accuracy, completeness, effectiveness, or fitness for a particular purpose). The Service is provided "as is".
2. The Operator is not liable for damage arising from use of the Service, except where caused by the Operator's willful misconduct or gross negligence. Where the Operator is liable, its liability is capped at the amount the User paid for the Paid Service.
3. Reminder notifications may fail to be delivered depending on the device's or OS's settings and state. The Operator is not liable for damage arising from undelivered notifications.
4. The Operator is under no obligation to respond to inquiries submitted through the contact form, and does not guarantee the timing or content of any response.

Article 8 (Changes, Suspension and Termination of the Service)

1. The Operator may change the content of the Service, or suspend or terminate its provision, without prior notice to Users.
2. If provision of the Service ends, the handling of data stored on the device and of purchased Paid Services will follow the guidance the Operator provides at that time.

Article 9 (Changes to these Terms)

The Operator may amend these Terms when it deems necessary. Amended Terms take effect when posted on this website. Material changes will be announced in the App or on this website.

Article 10 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. Any dispute arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Operator's location.
